2. WHEN THESE TERMS APPLY

These Terms of Sale apply whenever you purchase products from us through our website or any other sales channel operated by Stolen Girlfriends Club.

These terms explain:

  • who we are

  • how we supply products

  • how contracts may be changed or cancelled

  • returns and refunds

  • your legal rights as a consumer

These Terms of Sale should be read alongside:

By placing an order with us, you confirm that you have read and agree to these terms.
If you do not agree to these Terms of Sale, you must not place an order.
The terms that apply to your purchase are the terms that are in effect at the time your order is accepted.

3. CHANGES TO THESE TERMS

We may update these Terms of Sale from time to time.
If we do, we will publish the updated version on this page and update the effective date above.
We recommend reviewing these terms before placing an order.

4. ELIGIBILITY TO PURCHASE

By placing an order you confirm that:

  • you are at least 18 years old, or

  • you have permission from a parent or guardian.

We reserve the right to cancel orders where we reasonably believe purchases are being made for resale or commercial distribution without our consent.

5. ORDER ACCEPTANCE

When you place an order, you are making an offer to purchase a product.
A contract between you and Stolen Girlfriends Club is formed only when we send you an order confirmation email.

We reserve the right to decline or cancel orders including where:

  • a product is out of stock

  • payment cannot be authorised

  • pricing or product information errors occur

  • the order appears fraudulent

  • we cannot deliver to the address provided

  • there has been a system or administrative error

If your order is cancelled after payment, we will issue a full refund.

6. PRODUCT DESCRIPTIONS

We make reasonable efforts to ensure that product descriptions, images and specifications are accurate.

However:

  • colours may vary depending on screen display

  • natural materials such as precious metals or stones may vary slightly

  • handcrafted pieces may differ slightly from product images

Such variations do not constitute defects.
Packaging may differ from images shown.
We reserve the right to discontinue products at any time.

 

7. PRICING

Prices are displayed in New Zealand Dollars (NZD), or your local currency unless otherwise stated.

For customers located in New Zealand, prices include GST where applicable.

For international orders, prices may exclude local taxes, duties, or import fees imposed by the destination country.

Customers are responsible for any:

  • customs duties

  • import taxes

  • brokerage fees

charged by the destination country.
Shipping costs are shown at checkout.

 

8. PRICING ERRORS

While we aim to ensure pricing accuracy, errors may occasionally occur.

If a pricing error is identified:

  • if the correct price is lower, we will charge the lower price

  • if the correct price is higher, we will contact you before processing the order

If a pricing error is obvious and could reasonably have been recognised as a mistake, we may cancel the order and issue a refund.

 

9. PAYMENT

Payments are processed through secure payment providers including Shopify Payments and other authorised payment gateways.

We accept major credit cards, debit cards and other payment methods displayed at checkout.

All payments are subject to authorisation by the card issuer.
If payment is not authorised, the order will be cancelled.

 

10. DELIVERY

Delivery timeframes vary depending on destination and shipping method.
Estimated delivery times provided at checkout are estimates only.

We are not responsible for delays caused by:

  • customs processing

  • courier disruptions

  • events beyond our reasonable control

Once the product has been delivered to the address provided, responsibility for the product passes to you.

 

11. INTERNATIONAL SHIPPING

For international orders:

  • the customer acts as the importer of record

  • customs clearance may require additional documentation

  • local duties or taxes may apply

These charges are determined by the destination country and are outside our control.

 

12. CHANGES TO YOUR ORDER

If you wish to change your order, please contact us as soon as possible.
We cannot guarantee changes once an order has been processed or dispatched.

 

13. YOUR RIGHTS UNDER NEW ZEALAND LAW

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Under these laws, products must be:

  • of acceptable quality

  • fit for purpose

  • as described

If a product is faulty, you may be entitled to:

  • repair

  • replacement

  • refund

depending on the circumstances.

 

14. CHANGE OF MIND RETURNS

If you change your mind about a purchase, you may request a return within:
14 days of receiving your order - unless otherwise stated.

Returned items must be:

  • unused

  • unworn

  • in original packaging

  • accompanied by proof of purchase

Refunds will be issued to the original payment method.

Shipping costs are non-refundable unless required by law.

Earrings, undergarments and swimwear, as well as some items marked Final Sale are not eligible for change-of-mind returns unless faulty.

You may start a return by logging into your account here. You will be required to input your email address and a one-time password code will be emailed to you to log in. 


15. FAULTY OR DAMAGED PRODUCTS

If you believe your product is faulty, please contact: online@stolengirlfriendsclub.com

Please include:

  • order number

  • description of the issue

  • photographs if possible

We will assess the item in accordance with consumer law and provide a repair, replacement, or refund where appropriate.

 

16. RETURNS PROCESS

To initiate a return please contact: online@stolengirlfriendsclub.com or log into your account here 

Once approved, you will receive return instructions.
You must send the product back within 14 days after approval.
Refunds are typically processed within  5 business days after receiving the returned item.

 

17. LIMITATION OF LIABILITY

To the extent permitted by law:

  • we are not liable for indirect or consequential losses

  • our liability is limited to the value of the purchased product

Nothing in these terms excludes liability where doing so would be unlawful.

 

18. INTELLECTUAL PROPERTY

All trademarks, designs, product designs, imagery, and branding associated with Stolen Girlfriends Club remain the intellectual property of Stolen Girlfriends Club.

Products or assets may not be reproduced, copied, or commercially exploited without permission.

 

19. EVENTS OUTSIDE OUR CONTROL

We are not responsible for failure or delay caused by events beyond our reasonable control, including:

  • natural disasters

  • supply chain disruptions

  • strikes

  • courier interruptions

  • government restrictions

 

20. GOVERNING LAW

These Terms of Sale are governed by the laws of New Zealand.

If you are purchasing from outside New Zealand, mandatory consumer protection laws in your country may still apply.

Any disputes will be subject to the jurisdiction of the courts of New Zealand, unless otherwise required by applicable consumer law.

 

PROMOTIONAL TERMS AND CONDITIONS

The following sections apply to promotional campaigns operated by Stolen Girlfriends Club.

GIFT WITH PURCHASE PROMOTIONS

From time to time, we will offer a complimentary gift-with-purchase promotion for purchases on our online or retail locations. All terms and conditions for this type of promotion is as follows: 

Conditions:

  • Available while stocks last.

  • One gift per qualifying order unless otherwise stated.

  • Gift cannot be exchanged for cash or store credit.

  • Returns of qualifying purchases may require the gift item to be returned.

  • Valid only during promotional window as stated at the time of event.

  • Only valid for purchases made on stolengirlfriendsclub.com or flagship locations.


SALE EVENT TERMS

Terms and conditions for all sale events unless explicitly deemed otherwise: 

  • Discounts apply only to selected products unless stated otherwise.

  • Discounts cannot be applied retroactively.

  • Offers cannot be combined with other promotions unless specified.

  • Products marked Final Sale may not be eligible for returns unless faulty.

  • Discounted orders do not qualify to earn/accrue loyalty reward points.
  • Gift vouchers, including digital egift cards are not valid for discounted pricing.
